    In trying to play the "devil's advocate", you still did not answer my question. i.e. "Let me ask you a simple question. What CAN be the "perceived benefit" from a rally like this that would make you think that it would be worth attending? Is it something like a guarantee for a GC in 2 months or a bill that passes next month that does everything we legals want? What is it?"


    i already have my GC but i share the pain and frustration of folks who do not..if a 7 month wait process for me was frustrating - i can understand what a 7 year process would be to others like me...
    With all due respect, I do not think you have a clue as to what a 7 year wait can be like. Having received your GC in 7 months, now I understand where all this critiquing is coming from (without offering any solution of course).


    People have been quoting Gandhi and his South Africa protests.........those were different times and different issues.........

    I'm still trying to understand your point...you do not want us to quote Gandhi, MLK or any others that could inspire and motivate us. You do not think a big rally will help. You do not think meeting lawmakers will help. As Walking_dude remarked before, so WHAT do YOU suggest we do?

    unless there are drastic and dramatic measures - concrete changes are not possible........small procedural victories - maybe........drastic change.....no way!

    Can you give a few examples of these "drastic and dramatic measures" that will give us "concrete changes"? I'm sure we are all ears and will be willing to employ these.

    You have such an active and analytical mind. Why not use it for something constructive like suggesting actual concrete steps that IV can take.

    My first reaction. You're kidding, right! Ever worked in marketing/sales?? When you go to sell your product or service, you try to sell it from the point of view of the customer. In this case, what the benefit can be from the point of view of the US govt and US economy. Yes, our primary aim is to get our GC's in a reasonable time frame. The slogans and messages are in support of these ( By the way both happen to be true).

    Incidentally, even the spark in Gandhi was ignited when he personally was insulted and thrown from a train. My point being that it is only when we personally are affected by an issue that we react to it. The reaction ofcourse differs based on our own individual character, personality and other traits.

    But look at it this way......i already have my GC but i share the pain and frustration of folks who do not..if a 7 month wait process for me was frustrating - i can understand what a 7 year process would be to others like me....if people who are waiting saw the utility of the rally....there would have been more than 2,000 in DC.........but clearly they did not.......i was willing to give it a shot - but unfortunately could not and did not want to specifically postpone something else to make it to DC.......

For example - we cannot even strike (non cooperation/ civil disobedience movement)....because we get paid by our respective private sector employers.....and our grudge is against the Govt - who do we strike against......?? and if we do strike or court arrest or adopt other forms of civil protest and by chance run up a police record in the process.......who would employ us in the future...in Gandhi's days - they did not have electronic background checks......!!


    Another take - if US can have an endless source of temporary workers coming in, paying into income tax and social security taxes and medicare taxes for a few years......and going back without claiming a single dime of social benefits......its the best possible situation for US....a forever young, qualified, minimum wages (i.e prevailing wages) earning tax paying transient population supporting/ subsidizing an archaic and otherwise struggling social security and healthcare system.

    just to take the "popular" Gandhian analogy a step further......There was Home Rule League and Congress in existence in India for a long time.....their objective was to petition the British Govt for small changes........and their ultimate goal was to get dominion status for india......only when Gandhi came on board plus supporters of other proactive forms of protest.....like Subhash Bose.....Tilak etc and the armed freedom struggle started (Bhagat Singh, Azad et al)......did Congress wake up and ask for "purna swaraj" (complete independence).......so from 1885 (founding of congress) to 1930 (Lahore Session of Congress when purna swaraj declaration was made) - nothing happened......british empire went from strength to strength.......then in 17 years - India got independence.......

    pl think about what i wrote objectively......and dont jump on me just because i am playing devil's advocate

    I diagree with you...Indian film Industry have very good directors, They are no way inferior to Hollywood. Firstly you can't compre them with Hollywood because they have differen audiances...Hollywood have money power so their movies are technically better, but as far as quality of movies Indian film industry is very good...It caters to all tastes. There are Shyam Benegal, Basu Chaterjee, Govind Nihlani for people who like simple senseful movies there are Karan Johar, Yash Chopra, Mani Ratnam for expensive, hip hop movies. There's RGV, Hirani, Rakyesh Omprakash Mehra for different story based movies. In my opinion caters to wide variety you need to pick up by your taste...

    I do not think there are good film institutes in India. I have interacted with many passouts from FTII and other colleges and found then lacking something. One has to travel outside India to learn and expose himself to the high quality film education.
    How many of the directors you have named received any film degree?
    I am not saying all Indian films are low standard compared to Hollywood films. We have trash films in Hollywood too. However the quality expectation and quality acceptance level of the viewers is low in India. Thus directors try not to push the boundaries so often.

    You cannot blame everyone on budget. Indian films have big budgets by Indian standards. You cannot convert their budgets in dollars and compare with Hollywood. In my experience , I have found that by and large people in creative professions in India are hesitant to push the envelope and try to do something 'safe'. Very few can think outside the box and those few are able to produce world class work.

    All this can change once viewers in India get more educated, critical and demanding. That will be the end of mediocrity and start of world class work.

    IT and BPO outsourcing is also leading to Americanization of Indian youth and Indian youth are spending their high salaries on American products. In no time you will see American fast food chains, groceries, and many American MNCs cashing on a Americanized Indian crowd and neutralize ( and will eventually exceed the investments they make).

    This is the beginning of Americanization. Most of you will not understand what I say because you are here in US for a long time and being first generation immigrants (on a limbo) keep up with your tradition. Americanization is like a slow bleed. IT and BPO is investment. Returns will come in form of MNCs and businesses and finally benefit American economy.

    Just go back to India and look into the ITand BPO companies and lifestyles of people there. it will be 5 times higher than what we follow here as the Americanization is already induced.

    Bottomline, do not underestimate America. They know what they do.

    I share your thoughts. There are a multitude of sectors/issues that are mimicking the American style. With the advent of ICICI, any body can pretty much walk in and get a loan with a 30 yr EMI. Imagine the number of people losing jobs in India, both at Multinational and local companies providing services if the economy tanks here. What are people gonna do with home loans they signed up for 30 yrs or what ever? Fore closures on a grand scale?? Indian economy has been going up.. up and up due to software services and BPO sector. With out any manufacturing, infrastructure building up it would be very difficult for Indian economy to sustain growth or level out gracefully when hit hard. IMHO, Just being the back office of the world will not get India on par with US.

    Current crisis in UK is just one example, and i'm not surprised to see "slow bleed" approach.
    It's up to individual situation and decision what to do next
    Gandhi was never an immigrant and was in SA for solving a legal case on a temporary contract. He was always wanting to go back to India but because of the conditions of Indians, he was urged to stay back and help them, he actually went back in between and again came back to SA for a more organized effort.

    The situation now is different. The Durbin Grassely bill lobbyists are basically doing what has been happening in UK where local population do not want Asian immigrants taking high paying challenging jobs in their own soil. They don't seem to care if these jobs go away because the effect will be long term and as such it is a known fact that in these days, we seldom see the immigrant community having a good cooperation, every immigrant feels that one less immigrant, it is good for him.

    This has been happening in every country where highly skilled migrants take job positions in countries like Aus, NZ, UK, Germany etc..

    The US system is harder to crack for anti immigrants than these countries. So they follow this slow bleed approach. On the long run their objectives will be met though it would force out high skilled jobs abroad.

    One good thing is that developing nations must capitulate on this and make their labor laws good and also copyright laws and patent laws so that innovation and products are developed in developing nations and so called developed nations will bleed technology and innovation.

    My FOIA request status says it's processed on 3/14/2011, can you please let us know how long does it take to get the CD after this?

    Yes, I got a CD from USCIS with all my I-140. I requested for copy of I-140 approval notice corresponding to I-140 tracking number SRC.XXXXXXXXXXX. This is the same number I got from my employer for online tracking on USCIS website. It took over 4 months. I submitted this as soon as got approval on my I-140. If you dont have the tracking number, you may try to get your A# from employer or attorney. You can use the same reason that you are changing address or that you need it for visa stamping. I believe they ask for A# in visa interview form.
    I have heard that few people got the tracking number using Infopass. Not sure how. I would suggest, that do not delay. Submit the FOIA form with whatever info you have. They might be able to pull your records based on the SSN# or I-94# etc. No harm in trying. I didnt had A#, so I left it blank.

    Are there any transfered cases which got approved? I am yet to see one. My service center is TSC but my case starts with WAC as it was sent to Calif for data uploading ...my bad luck...I will be current next month but i doubt any transfered cases will get approved...

    just fell thru the cracks....anyway good luck for those who are straight forward cases (if there are any)

    Your case might just be a coincidence unless we have lot of transferred cases not being approved. Speaking of which we see this handle Visual whose PD is Jan 03.

    If transferred case is the road block, you guys have a strong case to raise, even legal action.

    The people who wants to be a part of American Society should first definately be a very open minded towards all cultures and social trends.
    Other thing to be Indian or representing Indian traditions is not a crime but certainly every time barking against anything Indian may certainly be a crime as it is a clear indication of closed door or prejudicial mind towards one particular country and culture. Americans do not mind if one shows that he is Indian now and want to become in American future. Although they prefer that AND that is why they label Jindal as Indian-American although he born in USA. If there are majority Indians on IV board, it is not a crime but it is obvious. Some of my chienese friends on IV board may start thread for wishing chienese festival, I bet most Indians on this board will welcome and same goes with Muslim friends on IV board. Starting and wishing EID MUBARAK thread (By the way that is also a Indian tradition..And I am proud of that too) is not a crime and by now if nobody started it does not mean other people may not welcome it. If you are a Muslim, start the thread for EID Mubarak, I will be the first to welcome that step. You want to be American,, right? Then first start learning open mind and start respecting the culture of majority IV memebers first. If you would not start that now how will you settle yourself in cultural pot of the world?

    If you are an Indian citizen right now take control over your inferiority complex and get over it because if you do not respect your culture or your tradition what guaranty would be there for Americans that you would respect American traditions in future.     I received my EAD last month. But no AP yet. However, i received an email from my lawyer today that.....my AP got rejected. The rejection letter is saying that I485 got approved that's why the I131 is rejected.....therefore, my lawyer is waiting for the I485 approval.....but my lawyer told me that I can expect my card soon.

    I don't know how to react. The online doesn't have any update about the I485 status yet. They received my application on July 2, 2007.

    Congratulations to Shimul99. Good for him.

    Did he have a aging out kid who filed for 485 along with him. I have heard thoses cases get prioritized.

    In any case, I am happy for him.

    I was under the impression based on some posts I read on other websites that even if your I-485 is approved before you applied for I-485 for your spouse, you can still add her if you were married before your I-485 approval date. Can someone confirm this ?? I feel the best way to handle the situation would be to apply for the I-485 of spouse on the date the PD becomes current. Keep all documents and applications ready and file on the first date. Since visa bulletin comes out 15 days in advance its good lead time to make preparations even if the movement of date is sudden.

    My company has offices in both canada(toronto and vancouver) and US .. i have worked for extended periods of time in canada. I agree that career development oppourtunities are limited due to economic reasons, but I there is no way toronto or vancouver can be considered "racist". And talking of high skilled workers, who said there is absolutely no discrimination in the US ? Isnt that what programmers guild and other labor unions are all about ? how come so many people support the blue collar illegal aliens (mostly meat-packers and lettuce pickers), but nobody cares about us, tax-paying, law-abiding highly skilled people ?

    The difference is at least the canadian immigration policy doesnt institutionalize the discrimination by making us wait in limbo forever, unlike the US laws. At the end of the day, I would rather live with "limited career development" opportunity in canada and change employers at will than be surrounded by plenty of such opportunity but have my hands tied behind my back by the US laws.

    As for "discrimination", we as immigrants always will have to bear with some discrimination,subtle or overt, from the native-born white collar workers whether in the US or anywhere else in the developed world. Our home country is the only one where you can expect to go and join the workforce without discrimination.

    Another example my ex-boss in US had. There was a homeless person in his area and he used to see him almost every day. One day he decided to do something, talked to him and asked him to sign-up with his church rehab group, get him a job etc....My ex-boss was serious but the homeless promptly rejected all the offers and instead he just wanted to remain as homeless only. He didn't even want to try....

    A question to the people who used AC21 and on EAD:

    I am on EAD and changed job (six months after the I-485 is submitted). The new employer - a well know tech company - insisted on sending the AC21 letter to USCIS, and I sent it. After sending the letters there were LUD's on I485 applications for me and wife and I assumed the letter reached the files. There was no activity after wards. Recently my wife went out of country and while coming back she went thru the AP parol process. The immigration officer asked her a few questions, one of them is where I am working. She mentioned my current company which made the officer to have a question mark on his face (the file he is looking at has my previous employer name). We were expecting this to happen and my wife quickly explained to him that my application was sponsored by so-and-so company (my previous employer) but later I changed jobs as per AC21. She even had a copy of AC21 rules with her. There was no problem but she was kept in waiting for another 30+ minutes until the immigration officer talked to 2 other officers. She got the impression that most of immigration people there are not really aware of AC21 and this made us think this could be a potential issue for those who used AC21.

    Did anyone had any issues like this. We were lucky not having too much of a hassle but was thinking on how to handle these port of entry interviews if someone used AC21.

    First of all, the letter is not a requirement when you switch jobs. It is a matter of personal preference on whether you want to send the letter. So there may not be any record in your file about the change.

    I have travelled using AP. I was not specifically asked this question.

    Now, all Immigration officers may not be aware of the AC21 law. It may be good to mention the law and wait for them to verify. From your example, looks like it is good for all the family members to know the AC21 law and maybe carry a document stating the law.

    Its a good heads-up for some of us who have switched jobs to carry AC21 document.
